29 Jan Update on the Navigation Act 2012 and Navigation Regulation 2013
The Navigation Act 2012 and the supplementary Navigation Regulations 2013 came into full operation on 1 July 2013 replacing the Navigation Act 1912. The Department of Infrastructure and Regional Development took three years planning, drafting and undertaking public and whole of Government Consultation to draft a contemporary legislative framework for maritime regulation.
The Act chiefly promotes maritime safety, the prevention of pollution of the marine environment and greater enforcement and inspection powers of the Australian Maritime Safety Authority (AMSA). The Act also gives effect to the relevant international conventions to which Australia is a signatory allowing for a greater recognition of international standards. The Act also provides an avenue for review of many decisions made under the Act by AMSA by allowing applications to be made to the Administrative Appeals Tribunal.
